شمار امضاکنندگان کنوانسیون حمایت از حرفه وکالت به ۳۴ کشور رسید
روند پیوستن کشورها به کنوانسیون شورای اروپا برای حمایت از حرفه وکالت مشهور به «کنوانسیون لوکزامبورگ»، در سال ۲۰۲۶ نیز ادامه دارد. بر اساس آخرین اطلاعات رسمی شورای اروپا، تاکنون ۳۴ کشور این کنوانسیون را امضا کردهاند. در سال ۲۰۲۶ کشورهای آلمان، پرتغال، اسلوونی، اوکراین، بوسنی و هرزگوین، سنمارینو، اسلواکی، آلبانی، اتریش و اسپانیا به جمع امضاکنندگان این سند پیوستهاند. شورای اروپا از این کنوانسیون بهعنوان نخستین معاهده بینالمللی الزامآور یاد میکند که بهطور اختصاصی برای حمایت از حرفه وکالت تدوین شده است. تدوین این سند در واکنش به افزایش گزارشها درباره تهدید، ارعاب، آزار، حمله و مداخله ناروا در فعالیت حرفهای وکلا صورت گرفته است. با وجود افزایش شمار کشورهای امضاکننده، امضای کنوانسیون بهتنهایی برای لازمالاجراشدن آن کافی نیست. مطابق مقررات کنوانسیون، لازمالاجراشدن این سند مستلزم تصویب آن از سوی دستکم هشت کشور، شامل حداقل شش عضو شورای اروپا است. بنابراین، مرحله تصویب داخلی کشورها نقشی تعیینکننده در تبدیل حمایتهای پیشبینیشده به تعهدات اجرایی خواهد داشت. از دیگر ویژگیهای مهم این سند آن است که امکان پیوستن کشورهای غیرعضو شورای اروپا را نیز پیشبینی کرده است. بااینحال، بر اساس سازوکار کنوانسیون، امکان دعوت از کشورهای غیرعضو برای الحاق پس از لازمالاجراشدن آن فراهم خواهد شد. گسترش استقبال از کنوانسیون لوکزامبورگ قطعا گامی مهم در مسیر شناسایی بینالمللی استقلال و امنیت حرفهای وکلاست لیکن میزان اثرگذاری واقعی آن به تصویب و اجرا و نظارت مؤثر بر رعایت تعهدات دولتها وابسته خواهد بود.

Number of Signatories to the Convention for the Protection of the Profession of Lawyer Reaches 34
The process of countries joining the Council of Europe Convention for the Protection of the Profession of Lawyer, commonly known as the “Luxembourg Convention,” has continued in 2026. According to the latest official information released by the Council of Europe, 34 countries have signed the Convention to date. In 2026, Germany, Portugal, Slovenia, Ukraine, Bosnia and Herzegovina, San Marino, Slovakia, Albania, Austria, and Spain joined the signatories to this instrument. The Council of Europe describes the Convention as the first legally binding international treaty specifically designed to protect the profession of lawyer. It was developed in response to the growing number of reported threats, intimidation, harassment, attacks, and improper interference affecting lawyers in the exercise of their professional duties. Despite the increasing number of signatory countries, signature alone is not sufficient for the Convention to enter into force. Under its provisions, the Convention requires ratification by at least eight countries, including no fewer than six member states of the Council of Europe. Domestic ratification will therefore play a decisive role in transforming the protections envisaged under the Convention into enforceable obligations. Another significant feature of the Convention is that it provides for the possibility of accession by states that are not members of the Council of Europe. However, under the mechanism established by the Convention, non-member states may be invited to accede only after the Convention has entered into force. The growing support for the Luxembourg Convention undoubtedly represents an important step towards the international recognition of the independence and professional security of lawyers. Its actual effectiveness, however, will ultimately depend on its implementation and the effective monitoring of states’ compliance with their obligations.
