ژنو؛ گفت‌وگوی رهبران کانون‌های وکلا درباره حاکمیت قانون، حقوق بشر و حکمرانی هوش مصنوعی

نشست رهبران کانون‌های وکلا به ابتکار اتحادیه بین‌المللی وکلا (Union Internationale des Avocats – UIA) روز ۴ سپتامبر ۲۰۲۶ در کاخ ملل متحد در ژنو برگزار شد. این نشست، نمایندگان کانون‌ها و نهادهای حرفه‌ای وکالت از کشورهای مختلف را در کنار مسئولان سازمان ملل متحد و دیگر سازمان‌های بین‌المللی گرد هم آورد تا زمینه‌های همکاری آنان در حمایت از حاکمیت قانون، دسترسی به عدالت و حقوق بشر بررسی شود.بخش نخست برنامه به مسئولیت کانون‌های وکلا در پاسداری از حاکمیت قانون، دسترسی به عدالت و حقوق بشر اختصاص داشت. حمایت حقوقی از پناه‌جویان و پناهندگان، حقوق اشخاص متأثر از مخاصمات، کار اجباری و قاچاق انسان و حکمرانی مهاجرت مبتنی بر حقوق بشر از موضوعات این بخش بود. نمایندگانی از کمیساریای عالی سازمان ملل متحد در امور پناهندگان، کمیته بین‌المللی صلیب سرخ، سازمان بین‌المللی کار و سازمان بین‌المللی مهاجرت در این گفت‌وگوها حضور داشتند.بخش دوم نشست به ادغام رویکردهای مبتنی بر حقوق بشر در مالکیت فکری و هوش مصنوعی اختصاص یافت. نمایندگان سازمان جهانی مالکیت فکری، دفتر کمیسر عالی حقوق بشر سازمان ملل و هیئت نمایندگی لهستان در ژنو، رابطه میان حقوق مالکیت فکری، فناوری‌های نوظهور، هوش مصنوعی و استانداردهای بین‌المللی حقوق بشر را بررسی کردند.برنامه رسمی، پرسش‌های مشخصی را نیز درباره مسئولیت حرفه‌ای وکلا در عصر هوش مصنوعی مطرح کرده است: وکلا چگونه می‌توانند هنگام استفاده از فناوری‌هایی که شناخت کاملی از آنها ندارند، تکلیف حرفه‌ای خود به برخورداری از صلاحیت و مهارت را رعایت کنند؟ محرمانگی اطلاعات موکلان در صورت پردازش داده‌ها توسط سامانه‌های هوش مصنوعی اشخاص ثالث چگونه باید حفظ شود؟ و هنگامی که یک ابزار هوش مصنوعی اطلاعات نادرستی تولید می‌کند که بر نمایندگی حقوقی موکل اثر می‌گذارد، مسئولیت بر عهده چه کسی خواهد بود؟این نشست بر جایگاه فزاینده کانون‌های وکلا در گفت‌وگوهای بین‌المللی تأکید دارد.

Geneva: Bar Leaders Discuss the Rule of Law, Human Rights and AI Governance
The Bar Leaders’ Briefing, organised by the Union Internationale des Avocats (UIA), was held at the Palais des Nations in Geneva on 4 September 2026. The event brought together representatives of bar associations and professional legal organisations from different countries, alongside officials from the United Nations and other international organisations, to examine opportunities for cooperation in supporting the rule of law, access to justice and human rights.The first part of the programme focused on the responsibility of bar associations to uphold the rule of law, access to justice and human rights. The subjects discussed included legal protection for refugees, the rights of people affected by armed conflict, forced labour and human trafficking, and rights-based migration governance. Representatives of the Office of the United Nations High Commissioner for Refugees, the International Committee of the Red Cross, the International Labour Organization and the International Organization for Migration participated in these discussions.The second part of the Briefing addressed the integration of human-rights-based approaches into intellectual property and artificial intelligence. Representatives of the World Intellectual Property Organization, the Office of the United Nations High Commissioner for Human Rights and the Permanent Mission of Poland in Geneva examined the relationship between intellectual property rights, emerging technologies, artificial intelligence and international human-rights standards.The official programme also raised specific questions concerning lawyers’ professional responsibilities in the age of artificial intelligence: How can lawyers fulfil their professional duty of competence when using technologies they may not fully understand? How can client confidentiality be protected when data is processed by third-party AI systems? And who should bear responsibility when an AI tool generates inaccurate information that affects the legal representation of a client?The Briefing highlights the increasingly important role of bar associations in international dialogue.
